A useful tool to protect business' competitive advantage
This academic melange begins with an introduction to trade secrets’ basic concept, starting from the universal definition given by the TRIPS Agreement. Then it exposes the kind of information that might constitute a trade secret and the three main elements for its existence according to the doctrine. In addition, it introduces an analysis of the common debate that inventors and innovators face between trade secrets and patents, analyzing the main points of this dispute as subject matter, procedures, costs, duration, infringement and social impact. Finally, it exposes three examples of globally successful trade secrets in different industries: beverages, household products, and telecommunications; followed by the exposition of the author’s conclusions from her personal point of view.
